David A. Castleman a partner in Raines Feldman’s New York office wrote, on a pro bono basis, an amicus brief that was filed in the Sixth Circuit Court of Appeals in the case of Digital Media Solutions, LLC v. South University of Ohio, LLC et al on behalf of the National Association of Federal Equity Receivers (NAFER). NAFER is the premier association for federal equity receivers and the professionals who support their efforts.
The brief was submitted to provide the court with context as to why bar orders are critical tools for receivers to maximize the value of receivership estate available to distribute fairly to all stakeholders and to explain why the abuse of discretion standard of review for approval of settlements should be maintained in light of the district court’s broad equitable power and close supervision of federal equity receivers.
